New lawsuits against Microsoft over Windows 10

Three Illinois residents have filed a lawsuit against Microsoft for data loss and damage to their computers when upgrading to Windows 10.

It's been two years since Microsoft began pressuring its customers to upgrade to Windows 10.The complaints filed this time concern this behavior by the company and appear to be very well-documented. Windows 10

The lawsuits accuse Microsoft of wasting users' time, losing money, damaging software, hardware, and causing mental anguish after upgrading to Windows 10.

Currently, 100 users of the operating system have gathered and are suing for over 5 million dollars in damages, in addition to legal costs and interest.

The main complainant, Stephanie Watson, says she never chose to upgrade to Windows 10 and lost her work data when she did. She then contacted Geek Squad to have her computer repaired. But the company was unable to resolve the issue with “complete success,” so she purchased another system.

Robert Saiger says he accepted the upgrade, but claims he lost data, "time and money, and everything got worse when he tried to recover his data.".

Howard Goldberg also approved the upgrade but says his “computer was damaged” because Windows 10 was not installed properly. Goldberg paid someone to repair his computer because it was out of warranty and is suing for his lost data, time and money, as well as his computer itself.

The complaint claims that Windows 10 is a consumer product under US law, and accuses Microsoft of being aware that the upgrade could cause data loss and hardware damage.

The plaintiffs aim to prove that the upgrade could cause data loss and hardware damage, that Microsoft was aware of potential software incompatibility issues, and that the upgrade without warning, as they claim, resulted in a violation of the terms of use.
