The German antitrust authority has accused Apple of abusing its market power through app tracking tool (App Tracking Transparency). The authority says that if Apple fails to comply with the regulations, it could face large fines.

The Federal Cartel Office has been investigating Apple's App Tracking Transparency (ATTF) feature for three years. The feature allows users to block advertisers from tracking them across apps.

“The ATTF (app tracking tool) makes it much more difficult for competing app publishers to access advertising-related user data,” said Andreas Mundt, president of the Federal Cartel Office.

Apple defended this security feature , even after the German authority's statement.

"We will continue to work constructively with the Federal Cartel Office to ensure that users continue to have transparency and control over their," he added.

However, Apple will be required to address the concerns raised by Germany's regulator, or it could face daily fines.

The case was sparked by complaints from associations representing publishers, broadcasters, advertisers, and ad tech companies.

“Today’s charges are groundbreaking. Apple’s measures had created an artificial opaqueness in its ecosystem that led to fewer choices, higher costs for apps and less protection against deceptive advertising, while boosting Apple’s services revenue,” said Thomas Höppner, a partner at law firm Hausfeld who is representing the plaintiffs.

The regulator argues that Apple may be relying on bogus privacy arguments to massively restrict competition in its favor.

Companies that violate Germany's antitrust rules risk fines of up to 10% of their annual turnover. Enforcement of these laws is essential to maintaining a healthy market environment where innovation can thrive while protecting consumers.
