$2 billion lawsuit over Apple Pay fees

A consumer advocate in the United Kingdom has filed a lawsuit claiming that Apple Pay’s share of the standard interchange fees charged by banks has harmed 50 million people at a total cost of $2 billion. The problem is that there doesn’t appear to be any real harm to consumers. The new lawsuit claims that the fees Apple charges banks are unfairly passed on to consumers.

Apple has already been sued in the past for allegedly profiting unfairly from high fees charged to card issuers. Then, card issuers Visa and Mastercard have been sued along with Apple Pay for high fees charged to merchants. Now, according to The Guardian, a financial activist in the UK is taking on Apple Pay over how its “hidden” fees affect consumers.

James Daley has filed a complaint with the Competition Appeal Tribunal (CAT) , seeking permission to bring a class action. Daley claims that Apple's charges for banks to use Apple Pay are excessive and ultimately burden consumers, even though there appears to be no direct cost to them. The banks, the lawsuit alleges, pass these charges on to their customers through higher interest rates or other banking charges.

This case comes at a time when the use of digital wallets is growing rapidly, and consumers are increasingly turning to contactless payments.

Apple, for its part, has defended its position, arguing that its fees are fair and reflect the value and security offered by Apple Pay. However, critics say Apple is exploiting its market position to impose high fees on banks, which in turn pass on the cost to consumers. The CAT decision could have significant implications for Apple and other technology companies that offer similar payment services.

If the lawsuit goes ahead, it could lead to significant changes in how these fees are imposed and passed on to consumers. The case also highlights growing concerns about the influence of big tech companies in financial markets and how their practices may affect consumers. As digital payments become more widespread, regulators around the world are closely examining the practices of these companies to ensure that consumers are protected from unfair fees and practices.
