Lawsuits against Google over AI Overviews dismissed

A federal judge has dismissed two lawsuits against Google filed by Chegg and Penske Media Corporation, the parent company of Rolling Stone. The companies accused Google of driving traffic away from their websites through its AI-powered search features. U.S. District Judge Amit Mehta sided with Google in a ruling issued Wednesday, writing that PMC and Chegg’s claims lack antitrust merit.

The lawsuits filed in 2024 by the two companies centered on the allegation that Google abused its monopoly powerby forcing publishers to provide content for AI Overviews for free or risk being removed from search results. The publishers claimed that Google’s practices drove traffic away from their websites, hurting their revenue.

Google, for its part, argued that its AI-powered search features are simply an evolution of technology that offers a better user experience.

Judge Mehta, who had issued a landmark ruling against Google in 2024, disagreed with Chegg and PMC’s claims. “Plaintiffs have only stated that they have an ‘expectation’ that Google will send them search traffic if they make their content available for free,” Mehta wrote. “But an expectation is not an agreement. It is simply the way a general search engine works.” This statement highlights the difference between an expectation and a legal obligation, which is crucial in antitrust law.

Mehta adds that the court is not concerned with the current situation of publishers, but writes that antitrust rules cannot replace a legislature’s decision to address the economic impact of “new innovation.” This observation highlights the need for legislative intervention in matters involving technological progress and its economic implications.
