India orders Meta to remove child abuse ads on Instagram

Pressure on major tech platforms to better protect minors is mounting worldwide, and Meta is now facing one of the most serious cases in recent years in India. The Ministry of Electronics and Information Technology (MeitY) has ordered the company to from Instagram all ads and content related to the trafficking of child sexual exploitation material, while also giving it seven days to explain how the ads managed to bypass internal review mechanisms.

The research that sparked the developments

The Indian authorities' intervention was prompted by a BBC Eye, which was published on July 3. According to the findings, a test account in India, following specific searches, began receiving dozens of sponsored ads on Instagram that referred to Telegram channels.

The channels allegedly distributed sexual abuse material child, with purchase prices starting at just 99 Indian rupees. The fact that the content appeared through paid advertising and not exclusively through organic search was of particular concern, as it raises questions about the effectiveness of Meta's automated review mechanisms.

The revelations led Indian authorities to summon company executives for questioning, and the case is now entering an even stricter stage of supervision.

Algorithms under the microscope

The government order is not limited to removing illegal content. The Ministry is asking Meta to present a specific plan to limit what it describes as the “algorithmic enhancement” of such material.

In other words, the authorities are examining whether the platform's recommendation and ad targeting systems contributed, even unintentionally, to the dissemination of illegal content to users who had made relevant searches.

This issue is one of the biggest challenges for social media platforms. Algorithms are designed to maximize user interaction, but in some cases they can end up amplifying harmful or illegal content before it can be detected and removed.

Risk of loss of legal protection

Meta now risks facing not only administrative sanctions but also significant legal consequences. Under India's Information Technology Act (IT Act), online platforms enjoy a so-called "safe harbor" status, which exempts them from direct liability for the content posted by users.

This protection, however, only applies when companies demonstrate that they have adequate procedures in place to prevent, control and promptly remove illegal content. If Indian authorities find that Meta failed to comply with its due diligence obligations, it could lose this important legal shield, opening the way for harsher penalties and potential legal action.

Meta has not yet made an official statement on the latest developments. However, the company has repeatedly stated in the past that it has a zero-tolerance policy against all forms of child sexual exploitation and cooperates with relevant authorities to identify and report relevant material.
