Tesla: There is evidence it knew its self-driving technology was flawed

A judge has found “reasonable evidence” showing that Elon Musk and other executives at Tesla knew the company’s self-driving technology was flawed but allowed the cars to drive anyway , according to a recent ruling issued in Florida .

Judge Reid Scott, who is also a federal judge, found Tesla guilty of using a marketing strategy that portrayed the products as autonomous, and that Musk's statements about the technology had a significant impact on the perception of the products' capabilities.

The ruling paves the way for a lawsuit over a fatal 2019 crash north of Miami involving a Tesla Model 3.The vehicle collided with an 18-wheeler truck that had swerved onto the road, ripping off the Tesla's roof and killing driver Stephen Banner.

The lawsuit, filed by Banner's wife, accuses the company of willful negligence and gross negligence, which could expose Tesla to large damages. The decision comes after Tesla won two product liability lawsuits in California last year that focused on alleged defects in its Autopilot system.

Judge Scott also found that Banner's wife should be able to argue to the jury that Tesla's warnings in its manuals and "clickwrap" were inadequate. He said the accident is "eerily similar" to a fatal 2016 crash involving Joshua Brown , in which the Autopilot system failed to detect trucks crossing the road.

Banner's attorney, Lake "Trey" Lytal III, said they are "particularly proud of this outcome, which is based on the evidence of irresponsible behavior."

The judge also cited a 2016 video showing a Tesla vehicle driving without human intervention as a way to promote the Autopilot system. At the beginning of the video is a disclaimer that states that the human in the driver’s seat is there only for legal reasons. “The car drives itself,” the video states.

Judge Scott said that “absent from this video is any indication that the video is ambitious or that this technology is not already on the market,” he wrote.

This decision has negatively affected Tesla's reputation and the value of its shares. In this decision, the judge has identified possible evidence that Tesla knew about the defective self-driving technology. This has created doubts in the public and has raised concerns about the safety of the company's products.

Additionally, the decision has led to a decline in investor confidence in Tesla. The revelation that the company may have known about faulty systems has raised concerns about the company's ability to produce safe and reliable products.
