Arrest of 2 Greeks for trafficking in digital personal data

Within the framework of a wide police operation, lists with 406.000 personal data records, such as full names, mobile phone numbers, postal addresses and email addresses – e-mails, were found in their home, stored on digital media

The investigation is continuing in order to determine precisely the amount of personal data, as well as its origin and further management - disposal

The Cybercrime Prosecution Directorate, after a police online investigation that lasted over four months, uncovered a case of illegal collection, possession, processing and sale of a large number of records with personal data, in digital files - lists.

For this case, a summary proceeding file was opened against two nationals, aged 52 and 53, for violation of the legislation “on personal data»”, acts committed in’ succession and in collusion. Simultaneously they are accused of also committing the offense of tax evasion and the legalization of income from criminal activities (money laundering).

Specifically, the investigation of the case began after a complaint was filed with the Cybercrime Division, according to which unknown actors, aiming to publicize their existence and activities, mass-send email messages to internet users, inviting business owners to purchase, for a fee, an electronic file they possess that contains a list of one hundred fifty thousand (150,000) email addresses.

Regarding the above, the Athens Juvenile Prosecutor's Office was informed, which also ordered the conduct of a preliminary examination, and issued related Orders and Resolutions for the lifting of the confidentiality of communications and of bank secrecy.

From the thorough digital and systematic online investigation conducted by specialized Officers of the Cybercrime Prosecution Directorate, in collaboration with the competent internet service companies, telecommunications and banking organizations, the details of the perpetrators were identified as well as the electronic traces through which they circulated personal data files via the internet.

Simultaneously, the communication phones they used for their illicit and illegal activities emerged, as well as the disputed bank accounts they used, in order for them to be paid the «compensation» for the sale of the electronic file of personal data.

In the early hours of yesterday (18-5-2015), a broad police operation was carried out, during which police officers from the Cybercrime Prosecution Directorate, with the assistance of a team from the Personal Data Protection Authority, carried out, in the presence of a Judicial Officer, parallel searches in the homes and workplaces of those involved in Attica.

From the on-site digital search carried out on electronic storage media located in the perpetrators' home in Athens, files - lists with 406,000 personal data records, such as names, mobile phone numbers, postal addresses and e-mail addresses - were found and seized in digital form. At the same time, a laptop computer was seized.

The seized digital evidence will be sent to the Criminal Investigations Directorate for laboratory tests.

The arrested individuals with the case file that was opened against them will be referred to the Athens Juvenile Court Prosecutor.
