The Human Rights Court ruled that employee surveillance is legal
The European Court of Human Rights has ruled that monitoring of employees' online communications by their employer is legal, rejecting the appeal of a Romanian who was fired for chatting online.
The plaintiff, a young engineer, claimed that his privacy had been violated: he was fired in August 2007 when his employer realized that he was using messaging software to chat not only with his colleagues, but also with his brother and his fiancée.

The company's internal regulations "prohibited the use of such programs for personal purposes," the Court explained. The dismissed engineer had appealed to the Romanian courts, but was unsuccessful. Like the Romanian courts, the European judges rejected the claim that his former employer had violated his private life and the confidentiality of his correspondence.
It is not abusive for “an employer to want to verify that employees are performing their professional duties during working hours,” the ECtHR noted in its decision. In addition, the employer checked the young engineer’s account “believing that it contained his communications with clients,” the Athens News Agency reported.
