"Tiresias S.A." is required to pay a fine of 75,000 euros by the Personal Data Protection Authority, because the company did not timely inform the Authority, nor those interested, about the operation of its new system.

This is the system for providing information on economic behavior to determine the creditworthiness of all types of businesses, called "Tiresias Risk Control System" (TSEK).

According to the APE-MPE, as stated in a relevant decision of the Authority, "Tiresias" implemented the new TSEK information provision system in June 2013, without having previously received the required permit.

In the first stage of operation of TSEK, "Tiresias" began by providing data on legal entities and in the second stage, it proceeded to provide entrepreneurs, natural and legal entities with the ability to access data on the economic behavior of natural and legal entities.

The Authority states that the purpose of TSEK is to provide "correct and up-to-date information on economic behavior to ensure commercial credit, reliability and security of transactions and ultimately the exercise of the right to economic freedom of entrepreneurs.".

In its decision, the Authority states that "Tiresias", in addition to informing the Authority with delay about the operation of the TSEK, did not inform interested parties, as he was obliged to do by law (Law 2472/1997), regarding the protection of personal data.

"Tiresias" states in a relevant document to the Authority that the information about the processing of personal data was provided "through the professional-recipient." In other words, the company "essentially transfers its own obligation to the respective data recipient," the Authority adds.

The Authority states that "Tiresias", through the operation of TSEK, did not fulfill the obligation to inform the interested party under the legislation before transmitting the data to the recipient.

The Authority, after taking into account the gravity of the violations of the law on the protection of personal data on the part of "Tiresia", as well as the insult caused to the interested and affected persons, imposed a fine of 75,000 euros.

In parallel, with another second decision, the Authority grants a license to operate the TSEK system to the company "Tiresias" and sets the rules and conditions under which it must be implemented.
