The request for protective measures submitted by the company AEPi (Greek Copyright Protection Society) was rejected by the Greek judiciary, demanding that providers block access to torrent files.
According to the court decision as published by the void.gr, the court ruled that the request of the AEPI violates the principle of proportionality, i.e., it is an excessive measure. furthermore, with the measures sought by the AEPI, not only illegal but also legal actions would be suppressed« not only illegal but also legal actions», given that torrent technology allows the exchange not only of pirated movies and music but also of legal files. the requested measures were thus found to violate freedom of information, the right to participate in the information society and the privacy of communications. moreover, the court notes that the requested measures do not meet the «criterion of suitability» because they would simply not be effective: the services torrent that were on the «blacklist» of the AEPI, such as the popular Pirate Bay, now operate on different online addresses (IP) and would remain accessible to users.
Furthermore, the AEPI's request was found to violate the EU Charter of Fundamental Rights. Specifically, it infringes the providers' right to entrepreneurship, as well as the principle of net neutrality, which stipulates that all information must be transmitted without discrimination.
The court, finally, comments that the infringed copyrights "concern increasingly less the creators themselves and more the interests of the cultural industry companies themselves)
