Asian News International (ANI), one of India's largest news services, has filed a lawsuit against OpenAI, highlighting a significant legal issue regarding the use of protected news content by artificial intelligence (AI) in the world's most populous country.
ANI filed a 287-page lawsuit in the Delhi High Court, accusing OpenAI of illegally using its content to train AI models and creating false information attributed to the agency. This is the first time an Indian media outlet has taken legal action against OpenAI over copyright issues.

During Tuesday's hearing, Justice Amit Bansal issued a summons to OpenAI after the company confirmed that ChatGPT did not access ANI's website. The next hearing is scheduled for January.
A representative of OpenAI said that the company is actively collaborating with news organizations worldwide, including India, to find partnership opportunities. The lawsuit increases global pressure on artificial intelligence companies regarding the use of protected material, with OpenAI facing more than twelve similar lawsuits in the US, as well as others in Canada and Germany.
OpenAI's defense, through Amit Sibal, argued that copyright laws do not protect facts and that ChatGPT allows websites to be exempt from data collection. ANI is particularly concerned about the so-called “misinterpretations» attributed to the agency, including false interviews.

The court plans to appoint an independent expert to examine the impacts of using content that is publicly available from AI models. The judge intends to examine additional technical aspects of the dissemination of news content in future hearings.
