Brazil's Data Protection Authority has temporarily banned Meta from processing users' personal data to train the company's artificial intelligence (AI) algorithms.

The ANPD found processing of personal data based on inadequate legal bases, lack of transparency, restriction of data subjects' rights, as well as risks for children and adolescents.

This decision came after the social media giant revised its terms of use, allowing the use of public content from Facebook, Messenger and Instagram for artificial intelligence training purposes.
A recent report by Human Rights Watch revealed that LAION-5B, one of the largest text-image datasets used to train artificial intelligence (AI), contained links to recognizable photos of Brazilian children. These photos put them at risk of creating malicious fakes that could lead to further exploitation and harm.
Brazil has around 102 million active users, making it one of the largest markets. The ANPD said that Meta's update violates the General Law on the Protection of Personal Data (LGBD), citing an "imminent risk of serious, irreparable or difficult to repair harm to the fundamental rights of the data subjects affected.".
Meta has five business days to comply with the order, otherwise it risks facing daily fines of 50,000 reais (about $8,808).

In a statement shared with the Associated Press, the company said the policy “complies with privacy laws and regulations in Brazil” and that the decision represents “a step back for innovation and competition in the development of artificial intelligence, further delaying the benefits of artificial intelligence to Brazilian citizens.”
The social media company has faced a similar backlash in the European Union (EU), forcing it to suspend its plans to train its artificial intelligence models using user data without the users' consent.
